Draft Rules relating to the Control of Information and Access to Interpol's
Files
|
The ICPO-International General Assembly, meeting in Cancún from 5 to
8 October 2004 at its 73rd session:
HAVING IN MIND Report
AG-2004-RAP-08
which puts forward a set of draft rules relating to the control of information
and access to Interpol's files,
RECALLING that, in application of
Article
24
of the Rules on the Processing of Information for the Purposes of International
Police Co-operation, the procedure for verifying conformity with the said Rules
on the processing of information by Interpol, and access to the Organization's
files shall be laid down in a set of rules,
ALSO RECALLING that, in application of Article 8 of Interpol's Constitution,
the General Assembly is empowered to lay down any regulations deemed necessary,
NOTING the opinion of the ad hoc Committee set up in application of Article
56 of the Organization's General Regulations,
APPROVES the findings of report
AG-2004-RAP-08
entitled 'Rules relating to the Control of Information and Access to Interpol's
Files' on the need to define and enhance the mandate of the Commission for the
Control of Interpol's Files;
CONSIDERING moreover that these Draft Rules relating to the Control of Information
and Access to Interpol's Files comply with the provisions which led to the establishment
of the Commission for the Control of Interpol's Files in conformity with the
Exchange of Letters concluded with the French Government on 3 November 1982
and approved by the General Assembly at its 51st session (Resolution AGN/51/RES/1);
APPROVES the Rules relating to the Control of Information and Access to Interpol's
Files as set out in
Appendix 1
to Report
AG-2004-RAP-08;
ABROGATES, therefore, Articles 15 to 27 of the 'Rules on International Police
Co operation and on the Internal Control of Interpol's Archives' (Resolution
AGN/51/RES/1);
DECIDES, however, that the method of determining the composition of the Commission
provided for in those rules shall continue to be applied, pending the amendment
of the Headquarters Agreement concluded with the French Government.
