Amendment of the Financial Regulations


The ICPO-Interpol General Assembly, meeting in Cancún from 5 to 8 October 2004 at its 73rd session:

BEARING IN MIND Article 8(g) of the Constitution, under the terms of which it is competent to determine the financial policy of the Organization,

ALSO BEARING IN MIND Articles 51 and 55 of the General Regulations, under the terms of which it is competent to approve any modifications to the Financial Regulations by a two-thirds majority in conformity with Article 44 of the Constitution,

HAVING STUDIED Report AG-2004-RAP-02 entitled 'Amendment of the Financial Regulations',

HAVING HEARD the opinion given by the ad hoc Committee set up in application of Article 56 of the Organization's General Regulations,

APPROVES the conclusions given in Report AG-2004-RAP-02 concerning the need to amend the Financial Regulations, particularly with regard to clarifying the framework for contributions to the budgets of the Sub-Regional Bureaus as well as for the debt rescheduling scheme;

DECIDES, therefore, to amend Articles 1, 3, 4, 8, 10 and 11 of the Financial Regulations as they read in the appendix to the present Resolution;

FURTHER DECIDES that these amendments shall take effect on 1 January 2005.

Article 1.3

The budget shall comprise:

  1. the general budget and the specific budgets;
  2. all income and expenditure, whatever its origin and source;
  3. all financing and allocation operations.

 

Article 3

3.1 Members' statutory contributions to the Organization's general budget are due annually and are compulsory.
 
3.2 The annual statutory contribution of Members shall represent a percentage of the general budget of the Organization.
 
3.3 Statutory contributions to the Organization's general budget are distributed among Members on the basis of their ability to pay.
 
3.4 The procedures and scale used to determine the distribution of contributions to the Organization's general budget shall be adopted by the General Assembly by a two-thirds majority.
 
3.5 The statutory contributions paid by member countries to the specific budgets for Sub-Regional Bureaus are due annually and are compulsory.
 
3.6 The contribution to the budget of Sub-Regional Bureaus shall be distributed among the member countries concerned, without prejudice to the financial commitments of the host country.
 
3.7 Notwithstanding Article 16.2 of the present Rules, any partial payment made by a Member shall be set, pro rata, against the amount due as the statutory contribution towards the general budget, and against the amount due as the statutory contribution to the specific budget intended to fund the Sub-Regional Bureau concerned.
 
3.8 Unless specifically stated otherwise, any other payment shall be considered to be a voluntary contribution. Permanent voluntary contributions may be the subject of a specific agreement between the donating country and the Organization.
 
3.9 Statutory contributions that are due when a Member withdraws from the Organization shall remain due.

 

Article 4

4.7 A Member's debt may be partially cancelled in the context of a debt-rescheduling agreement concluded with the Organization in conformity with the terms of the present Article. To this end, the debt shall be partially suspended during the implementation period of the agreement. However, the suspended debt shall again become due if the Member fails to fulfill its obligations arising from the rescheduling agreement, or does not promptly pay the statutory contributions called up during the period in which the rescheduled debt is being paid off.

 

Article 8

8.1 The budget document shall necessarily consist, for the general budget and the specific budgets, of the following sections:

Article 10

10.1

Following proposals from the Executive Committee, the General Assembly shall:

  1. decide the total budget and establish the scale of distribution for statutory contributions due for the general budget,
  2. approve the draft budget and accompanying documents referred to in Article 8.

Article 11

11.2 The Secretary General may, with the prior approval of the Executive Committee, transfer appropriations from one programme to another, and transfer credits from the general budget to a specific budget, and vice versa.
