Commission for the Control of INTERPOL's Files
The Commission for the Control of INTERPOL's Files operates within a clearly defined legal structure.
The reference texts and rules are divided into two categories:
Texts adopted by the Organization:
- The Organization’s Constitution;
- Rules on the Processing of Data;
- Rules on the Control of Information and Access to INTERPOL's Files.
Rules adopted by the Commission:
The Commission adopted transparent operating rules on 31 October 2008 to maintain the Organization’s immunity from legal process.
These rules, which came into force on 1 November 2008, include provisions concerning all three of the Commission’s functions and reinforce the Commission’s legal status within the Organization
The creation and enforcement of the Commission’s Operating rules signified a crucial step in safeguarding the judicial immunity of INTERPOL and strengthening the legal status of the Commission.
The Commission takes into account General Assembly resolutions, Executive Committee decisions, Secretary General instructions and memoranda, as well as the Commission's own principles and precedents, based on general legal principles applicable to data protection matters, as set out in its Annual Reports.
